These terms of use ("Agreement") govern your use of the website zumbinikidz.com (“Website") and attending the Zumbini class/sessions (“Class”). By accessing or using the Website or by attending the Class, you agree to be bound by this Agreement. If you do not agree to these terms and conditions, please refrain from using the Website or registering to attend the Class.

1. Acceptance of Terms

   1. You must be at least 18 years old to use the Website.

   2. By using the Website or attending the Class, you acknowledge that you have read, understood, and agree to be bound by these terms of use.

2. User Conduct

   1. You agree to use the Website only for lawful purposes and in compliance with all applicable laws and regulations.

   2. You shall not engage in any activity that may interfere with the proper functioning of the Website or infringe upon the rights of others.

3. Conduct and Safety in the Class

   1. ​You agree to conduct yourself & your kid in a respectful manner towards the Instructors, staff, and other participants.

   2. ​You agree to follow all instructions and guidelines provided by the Instructor for your safety and the safety of others.

   3. You acknowledge that the Instructor may refuse or discontinue your participation if you or your kid’s behaviour poses a risk to yourself or others and the Class fee will be forfeited.

4. Intellectual Property Rights

   1. The content on the Website, including but not limited to text, graphics, images, logos, and software, is protected by copyright and other intellectual property laws.

   2. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content obtained from the Website without prior written permission.

   3. All choreography, routines, music and dance content provided during the Class are the intellectual property of Zumbini and/or Zumbinikidz.

   4. You agree not to record, reproduce, distribute, or perform any dance routines or choreography taught during the Class without the prior written consent of Zumbini or Zumbinikidz

   5. ​​You grant the Zumbini Instructor the right to take photographs or videos during the Class. If you have any objections, you must notify the instructor immediately and in writing to Zumbinikidz within 24 hours of the end of Class about your objection.

   6. ​We retain all rights, including copyright, to the photographs taken during the Class. You acknowledge that the photographs and videos are creative and intellectual property of Zumbinikidz

   7. ​Zumbinikidz may use the photographs and videos for promotional purposes, including but not limited to their portfolio, website, social media, and marketing materials.

   8. If you have any objections to the use of specific photographs or your likeness, you must notify Zumbinikidz in writing within 24 hours of the end of Class.

5. User Submissions

   1. If you submit any content to the Website, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

   2. You represent and warrant that you have the necessary rights to grant the above license and that your content does not violate any applicable laws or infringe upon the rights of any third party.

6. Links to third party websites

   1. The Site includes links to various third party websites. We are providing these links solely as a convenience. Such linked third party sites are not under our control. We have not reviewed all of the sites linked from the Site and are not responsible or liable for the contents available at any such linked site. The appearance of a third party link on the Site does not imply our endorsement of the linked site, its sponsors or any products or services offered on the linked site. Use of any linked site is at your own risk.

7. Limitation of Liability of use of Website

   1. You acknowledge and understand that participating in Zumbini Class involves certain inherent risks, including the risk of injury.

   2. You agree to release and hold harmless the instructors, staff, and their respective representatives from any liability for any injuries, damages, or losses incurred during or arising from your and your kid’s participation in the Zumbini Class.

9. Health and Medical Conditions

   1. a. You represent that you and your kid are in good health and have no medical conditions that would prevent you and your kid from participating in the Class.

   2. If you have any known medical conditions, injuries, or limitations, you agree to inform the instructor prior to participating in the Class.

   3. You understand that it is your responsibility to consult with a healthcare professional before participating in the Zumbini Class if you have any concerns about your health or physical condition.

10. Indemnification

    1. You agree to indemnify and hold us harmless from any injuries, claims, liabilities, damages, losses, costs, or expenses arising out of your use of the Website or attending the Zumbini Class or any violation of this Agreement.

11. Governing Law and Jurisdiction

    1. This Agreement shall be governed by and construed in accordance with the laws of India.

    2. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Bangalore.

12. Modifications

    1. We reserve the right to modify or amend these terms of use at any time.

    2. Any changes to this Agreement will be effective immediately upon posting on the Website.
